These Terms of Service (“Terms”) govern your access to and use of the BrokerBaat platform operated by BrokerBaat Technologies Private Limited (“BrokerBaat”, “we”, “us”). By signing up for an account or using our services, you agree to be bound by these Terms.
1. Service description
BrokerBaat is a WhatsApp-native AI lead management platform for real estate agencies. The service includes:
- Automated qualification of buyer leads via WhatsApp using AI.
- Lead scoring (HOT / WARM / COLD) and morning briefings to your agents.
- IVR call transcription and AI-driven coaching insights.
- A web portal for analytics, lead management, and inventory.
2. Account & eligibility
You must be at least 18 years old and authorised to bind your real estate business to enter into these Terms. You are responsible for keeping your login credentials confidential and for all activity under your account.
3. Subscription & billing
BrokerBaat offers paid subscription tiers. Current pricing is available at brokerbaat.in/landing.html#pricing.
- Subscription fees are billed monthly, quarterly, or annually via Razorpay.
- Usage above the included monthly lead quota is charged at a per-lead overage rate, debited from your wallet balance.
- Failure to maintain a valid payment method or sufficient wallet balance may result in service degradation per §6.
4. Acceptable use
You agree not to:
- Use the platform to send unsolicited bulk WhatsApp messages or violate Meta's WhatsApp Business Messaging Policy.
- Upload or transmit content that is unlawful, defamatory, infringing, or harmful.
- Reverse-engineer, scrape, or attempt to access the platform through any interface other than the ones we provide.
- Use the platform to harass, harm, or deceive buyers or any third party.
- Misrepresent property details (RERA-compliant disclosures are your responsibility as the broker).
5. Your data & content
You retain all rights to the content you upload (property listings, agent names, photos). You grant BrokerBaat a limited license to process this content solely to deliver the service. We act as a Data Processor for buyer-lead data; you are the Data Fiduciary. See our Privacy Policy for details.
6. Suspension & termination
We may suspend or terminate your account if:
- You materially breach these Terms or our acceptable use rules.
- Payment is unsuccessful and remains unresolved after a 7-day grace period.
- Required by law or by a platform we depend on (e.g., Meta WABA suspension).

7. Service levels & availability
We aim for high availability but do not currently offer a contractual SLA on uptime. Planned maintenance and outages are communicated via the in-app notification and email to the account owner.
8. Third-party services
Our service integrates with third-party providers including Meta (WhatsApp), Anthropic (Claude AI), OpenAI (Whisper), Razorpay (payments), Exotel (IVR), and AWS (infrastructure). Your use of these features is subject to the relevant third party's own terms.
9. Disclaimers
The platform is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law. AI-generated content (lead scores, coaching flags, briefings) is for informational support only and is not a substitute for the broker's own judgement.
10. Limitation of liability
To the maximum extent permitted by law, BrokerBaat's aggregate liability in connection with the service in any 12-month period shall not exceed the fees you paid us in that period. We are not liable for indirect, incidental, or consequential damages including lost profits or lost deals.
11. Indemnity
You agree to indemnify BrokerBaat against claims arising from your breach of these Terms, your use of the platform in violation of law, or your content infringing third-party rights.
12. Governing law & dispute resolution
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at [TO BE FILLED — city of registered office, e.g. Jaipur, Rajasthan]. Parties shall first attempt to resolve disputes through good-faith negotiation before commencing formal proceedings.
13. Changes
We may revise these Terms from time to time. Material changes will be notified at least 14 days before they take effect via in-app notice and email.
